In consideration, along with acceptance of my entry fee, of being permitted to participate in the Helio Health Run for Recovery, I understand that running a race is an inherently hazardous activity which could cause damage to my property and/or injury to my person up to and including death. Further, I understand that the Run for Recovery is a trail race that takes place on uneven terrain without animal restriction. I, nevertheless, agree to assume all risks inherent in participation in such program, whether they are apparent to me or not. I certify that I am in good physical health and fit to participate and agree that I will not participate unless I am medically able and properly trained.  I agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever. I hereby waive and release, for myself and for my heirs and assigns, any and all claims, causes of action, or liabilities which may hereafter accrue against The Helio Health Foundation, and its affiliates, their agents, employees, volunteers, officers, directors, successors and assigns, Helio Health and any and all sponsors, their representatives and successors, that may arise as a result of my participation in the Run for Recovery, including any and all claims for personal injuries caused by The Helio Health Foundation’s or Helio Health’s negligence. Further, I hereby grant full permission to any and all of the foregoing to use any photographs, motion pictures, recordings, or any other record of these events for any legitimate purpose, including commercial advertising, without monetary payment to me. (This information is protected by the Privacy Act).  I also understand that entry fees are not refundable under any circumstance, race registrations are not transferable to other participants or future years races. The Helio Health Foundation reserves the right to modify or cancel the race for safety concerns, trail condition concerns or natural disaster. In such cases there will be no refunds of race entry fees. This release shall be construed under the laws of the State of New York.  In the event any provision of this Release is deemed unenforceable by law, The Helio Health Foundation and/or Helio Health shall have the right to modify such provision to the extent necessary to be deemed enforceable; and all other provisions of this Release shall remain in full force and effect. I execute this Release voluntarily without any inducement, assurance or guarantee being made to me and intend my signature to be a complete and unconditional release of liability to the greatest extent allowed by law.
