In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, Marathon Majic, LLC, Stable View and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.

Stable View Trail Walking and/or Running Event Waiver and Release of Liability

By signing this waiver, I, the undersigned participant, acknowledge and agree to the following:

Assumption of Risk:
I understand that participating in a trail walking and/or running event involves physical exertion, and that the activity may take place on trails that are uneven, rocky, slippery and potentially hazardous.

I acknowledge and fully understand the inherent risks involved in trail walking and/or running, including but not limited to: falls, collisions, encounters with wildlife, extreme weather conditions, and other risks that may cause injury or death. I voluntarily choose to participate in this event, fully aware of these risks.

Medical Fitness:
I confirm that I am physically capable of participating in this trail walking and/or running event. I have no medical conditions that would prevent me from participating in this activity, and I have not been advised by any medical professional not to participate. I am responsible for ensuring that I am physically fit to take part in this event.

Release of Liability:
I hereby release and hold harmless Stable View, LLC, its members, sponsors, volunteers, employees, agents, officers, insurers, successors, assigns and all other persons or entities involved in the organization of this event (collectively referred to as "Releasees") from any and all liability, claims, actions, damages, or losses arising from my participation in this event, including injury, death, or property damage, even if caused by the negligence of the Releasees.

Indemnity:
I agree to indemnify and hold harmless the Releasees from any and all claims, demands, actions, damages, or liability arising out of my participation in the event, including any claims made by third parties for injury, death, or damage caused by my actions.

Use of Image and Likeness:
I grant permission to Stable View, LLC to use my name, image, voice, and likeness in photographs, videos, or other media for the purpose of promoting the event or for any other lawful purpose, without compensation to me.

Emergency Medical Treatment:
In the event of injury or illness during the event, I consent to receive emergency medical treatment. I agree to bear all costs of such medical treatment and emergency transportation, if necessary.

Compliance with Rules:
I agree to comply with all event rules, regulations, and instructions provided by event organizers, volunteers, and staff during the event. Failure to comply may result in my disqualification from the event.

SC Code 27-3-30:
I understand and am aware that SC Code Annotated Section 27-3-30 states that Stable View, LLC owes no duty of care to keep the premises safe for entry or use by me for recreational purposes nor to give any warning of a dangerous condition, use, structure, or activity on such premises to me entering for such purposes.

Acknowledgment of Understanding:
I understand that I am waiving the right to bring a lawsuit or make any other claim against the Releasees and I further understand that this release and indemnity will be presented as a complete defense against me if I or my estate does bring any lawsuit or claim against the Releasees.  This release and indemnity shall be binding upon my heirs executors, administrators and assigns.  MY SIGNATURE BELOW CERTIFIES THAT I HAVE READ THIS DOCUMENT AND UNDERSTAND IT.  I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARY SURRENDER CERTAIN LEGAL RIGHTS.
