Eat-Drink-VegFest Market Vendor Agreement

All vendors must sign this agreement when registering for the event.  This is the waiver that is signed as part of the registration process and is made available here for your review.

Rules, Procedures, and Operating Guidelines 

 

  1. INTRODUCTION Expert Event Solutions LLC. (“EES”), is a small business dedicated to operating and supporting local events, markets, and festivals that are focused on improving the local community in Volusia County, Florida and the surrounding areas. 

 

As part of that mission, EES conducts the Vegan focused market known as the Eat-Drink-VegFest (the “Markets”). The goal of the Markets is to provide an outlet for local vegan and vegetarian focused businesses, food trucks, locally grown farm products and locally created products to be sold directly to the public by vendors. 

 

The Markets are coordinated and governed by the EES Board (“Board”). The Board, or any committee designated by the Board for such purpose (“Market Committee”), is responsible for implementing and enforcing the Market Rules as well as for reviewing applications to participate at the Markets. In addition, the Board and/or Market Committee will appoint a Manager responsible for running the onsite activities of the Markets. 

 

The Market Managers have the final authority in interpreting and enforcing the necessary Standard Operating Procedures in a fair manner. EES reserves the right to make additions or deletions to these procedures when deemed. Participants will be notified of these changes. 

 

II.MARKET INFORMATION AND HOURS - 

  • Eat-Drink-VegFest, Saturday, 10:00 AM - 6:00 PM, Sunday, 10:00 AM - 4:00 PM,  rain or shine Manatee Island at Riverfront Esplanade 351 N Beach Street, Daytona Beach, FL 32114

 

Management has the right to change the hours of operations. If hours change, vendors will be notified via email. 

 

Intent and Implementation: The purpose of this set of procedures is to govern the operation, administration and management of the EES Eat-Drink-VegFest Market.  Market management will implement and enforce all procedures pertaining to the operation of the Market in a fair and equitable manner. 

 

III.VENDOR DEFINITIONS AND PERCENTAGES The Markets are primarily focused on local vegan and vegetarian businesses, food trucks, locally produced environmentally and sustainable products, farm products, but also provide space for local and sustainable processed/value-added foods, plants, crafts, and other products. 

 

At EES, we support and require growers who produce products free of harmful pesticides; growers who are responsible stewards of the land and the environment in which we all live. We only allow chemical-free and no harmful pesticide & herbicide free produce. 

 

Participating vendors who advertise their product as organic must be certified organic by a recognized certification agency and must display their certificate. 

 

All participants must comply with all federal, state, local regulations, special statutes and ordinances regarding public health, safety and welfare, including but not limited to, product labeling laws and required licenses. 

According to the Florida Department of Agriculture and Consumer Services: 

  • Each retail farmers market in Florida is independent and establishes its own vendor rules. 
  • Vendors selling by weight should contact the Bureau of Standards at (850) 9211590 to have their scales certified. 
  • For those selling processed food items, check with the Division of Food Safety at (850) 245-5595 for the appropriate permits. 
  • For those selling only fresh fruits and vegetables, no license or permit from the Florida Department of Agriculture and Consumer Services is needed. 

 

The vendor categories are as follows: 

  • Agricultural Producer: Produces a raw agricultural product, including but not limited to Ranchers, Beekeepers, Farmers and individuals practicing the art of agriculture. 
  • Raw Milk/Raw Milk Products: It is illegal to sell raw milk in Florida for human consumption. ... Without pasteurization, a heating process that kills bacteria, raw milk can be ripe with potentially deadly pathogens like E. coli, Listeria, and Campylobacter. Raw milk can be sold when labeled as “pet food” and there are no laws against drinking it. Raw milk products for human consumption are illegal. The Department of Agriculture and Consumer Services interprets the definition of "sell" in the state administrative code to extend the ban on raw milk sales to any cow share agreements as well. Department of Agriculture policy permits the sale of raw milk products for animal consumption even though there is no state law that covers this issue. The state permits raw milk sales for animal consumption either on the farm or in retail stores. Containers should have a label clearly stating that the raw milk is for animal consumption only. Labeling of shelf life. - To ensure consumers full disclosure of the date beyond which raw milk or milk products may no longer be offered for sale, 
  • Processed and/or Value-Added Food Vendors: Sells a food product produced off site in compliance with local and state codes. 
  • Plant Vendors 
  • Food Truck Vendor: Motorized vehicles with on board power, refrigeration, food preparation facilities, and usually room for two to four employees 
  • Craft/Art Vendors: A person who practices any of the various creative arts. Products must be original and not assembled from kits, including licensed logos or commercially available patterns. Pieces must display a high level of originality and craftsmanship. The applicant vendor must have actively participated in its production or in the production of the raw ingredients used in the finished item. 
  • Nonprofit: An entity that the Internal Revenue Service has determined “tax exempt” and has issued the entity a Letter of Determination. (Please provide a copy of your organization’s Non-profit determination Letter) 

 

IV.FEES Fees for market booth spaces must be paid in advance to EES via the Vendor Registration page at https://runsignup.com/TicketEvent/EatDrinkVegFestVendorRegistrationPage. All registration questions must be answered during the registration process. All fees are nonrefundable. The Markets are all-weather markets, booth payments are not refunded. In the case of Management canceling the market, a refund may be considered but not guaranteed. If payments are not made in accordance with procedures, future reservations may be revoked. 

  • Fees for each category are listed on the Registration Page
  • Reservation and fee are due by 12:00PM on the Wednesday evening, October 5th, preceding the Market.  
  • Cancellation/No Show fee: If vendor cancels their reservation less than 48 hours prior to the market opening time or fails to notify EES of cancellation there will be no refund of any fees.  Cancellation of reservation less than 1 week prior to the market and more than 48 hours prior to the market opening time will result in a cancellation fee of $50.  Cancellations more than 1 week prior to the market will receive a refund of fees minus the processing fees.



  1. GENERAL VENDOR REQUIREMENTS The following requirements apply to all Market vendors regardless of vendor category. 
  • Producer Only Markets. All items offered for sale must be grown or made by the seller or an immediate family member, except as otherwise noted in these Market Rules. 
  • Attendance. Scheduled vendors must open and set up by the beginning of the Market and must remain open and vending until the close of Market for which they are scheduled, unless there is a legitimate emergency.
  • Sales. No sales shall occur before or after Market hours. (pre-authorized by the Market Manager)  Nothing may be sold outside of the vendor’s assigned space (e.g. there will be no selling out of vehicles). 
  • Booths. The Market Manager will assign spaces. Vendors are responsible for keeping their spaces clean during and after the Market. All vendors must have tents. Tents and all other equipment must be properly secured (i.e. tents must be secured using weights and/or stakes). 
  • Professionalism. Vendors must maintain a courteous and professional manner at the Market. No smoking, consumption of alcohol, and profanity are allowed on Market premises. No alcohol may be consumed at the Market. Vendors are expected to treat each other, customers, and Market workers with respect. 
  • Vendor Code of Conduct. Expert Event Solutions (EES) duty is to ensure that all our transactions are safe, transparent, and exceed expectations for all participants. We endeavor to ensure that everyone that participates in our markets, including our customers and vendors, has a pleasant and rewarding experience. EES prohibits discrimination in all its forms, programs and activities on the basis of race, color, creed, national origin, age, disability, gender, marital status, familial status, religion, sexual orientation, veteran status, or socio-economic status including discrimination or harassment because all or part of an individual’s income is derived from any form of public assistance. EES prohibits discrimination and harassment based on race, religion, creed, gender, sexual orientation, veteran status, uniform service member status, and any other protected class under federal, state, or local law. EES prohibits the following inappropriate conduct: sexual innuendos, lewd remarks, threats, epithets, derogatory comments, visual depictions, unwelcome comments, jokes, and/or teasing. 

 

All discrimination, harassment, and inappropriate conduct is prohibited in any form including verbal, non-verbal, and physical unwanted acts and not limited to face-to-face, e-mail, voicemail, chat rooms, Internet use or history, text messages, videos, pictures, images, writings, words or gestures. Discrimination, harassment, and inappropriate behavior in the markets and/to other vendors, shoppers, EES staff will not be tolerated. Violations of this Code of Conduct may result in disciplinary action, including permanent removal/inactive status from the market. There will be no adverse action taken against anyone who reports violations of this policy in good faith, but EES requests that all reported violations of state and/or market requirements are first reported to Expert Event Solutions (EES). 

  • Cancellations. Vendors wishing to cancel their scheduled attendance at a Market must notify the Market Manager at least 1 week prior to the date of such Market. Failure to do so will result in a late notice cancellation fee as indicated above. (unless there is a proven emergency) 
  • Market Management will schedule and locate vendor stalls on a basis to best meet the desired Market composition and ensure a diverse and quality offering for customers. 
  • Vendors are responsible for all market fees according to the finalized schedule, except as indicated in the Cancellation Policy. 
  • Market Management will maintain a list of eligible vendors to fill cancellations. Vendor fees for fill-ins are due before opening on Market day. 
  • Market Management shall assign and maintain a booth area for the use of local non-profit organizations, and Non-profits must complete a vendor application, must submit Letter of Determination prior to approval and adhere to these Standard Operating Procedures. 
  • Liability. Vendors are liable for their products. Expert Event Solutions (EES, The Riverfront Esplanade and the City of Daytona Beach and Volusia County shall not be held accountable for the products offered by vendors. It is recommended that each vendor have a minimum of $1 million of liability coverage. 
  • Insurance. Food vendors are required to submit their Certificate of Insurance for Comprehensive General Liability with limits of $1,000,000 per occurrence and $1,000,000 aggregates. Expert Event Solutions LLC, New Smyrna Beach, FL, and Eat - Drink - VegFest, Daytona Beach, FL shall be listed as additional insureds and provided with a ten-day cancellation notice. 
  • Indemnification: To the fullest extent permitted by law, vendors shall indemnify and hold harmless Expert Event Solutions LLC, all of its Volunteers, Market Managers and/or Board Members, Eat - Drink - VegFest, Riverfront Esplanade, City of Daytona Beach, and Volusia County, Florida, and employees/staff from and against liability, claims, damages, losses and expenses, including attorney’s fees, arising out of or resulting from participation in the Market, provided that such liability, claims, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or injury to or destruction to tangible property including loss of use resulting there from, but only to the extent caused in whole or in part by negligent acts or omissions of the vendor or anyone directly or indirectly employed by them or anyone for whose acts they may be liable, regardless of whether or not such liability, claim, damage, loss or expense is caused in part by a party indemnified hereunder. 
  • Weather. The Markets are rain or shine events. The safety of vendors and shoppers at the Markets is of the highest priority and the Market may be canceled or shortened due to dangerous weather conditions. The Market Manager will monitor weather reports and determine if a Market will be closed due to inclement weather. Because the Markets are rain or shine events, vendors are expected to take appropriate precautions to ensure that rain will not impact their goods. This may be done through the use of items such as waterproof plastic carrying cases and waterproof packaging, or other appropriate measures. If the weather is predicted to or begins to deteriorate, the Market Manager may  “call” the market. That means the market is canceled and vendors need to orderly and quickly pack up their gear and leave. 
  • Vehicles. To ensure the safety of our shoppers and vendors, vehicles are not permitted on Market grounds during Market hours or within fifteen minutes prior to the start of each Market. (Vendors must be set up and vehicles removed from the market area fifteen minutes prior to market opening). 
  • Signage. All Vendors should have Signage, and whether affixed to the tent or on the ground, must be kept clear of the walkway. 
  • Compliance. Vendors must comply with all local, state, and federal laws, rules, and regulations, including, but not limited to, all licensing and labeling requirements and must provide copies of insurance, permits and/or licenses. 
  • For all new vendors: To ensure compliance, the Market Manager will inspect all labeling requirements upon the first vendor booth at the market. 
  • Vendors are encouraged to review Florida Statutes Section 500.80 on Cottage food operations before application to the Markets and to reference the website of the Florida Department of Agriculture and Consuage food law basics. mer Services for approved cottage food products and cottage laws. 
  • Copy of Florida Law: Failure to accurately and truthfully identify 

food items for sale, such as substituting tomatoes grown out of the country as tomatoes from a nearby farm, is a violation of Florida law. 

  • Violators are subject to fines of up to $1000 per occurrence, license suspension, or license revocation. DBPR sanitation and safety inspectors actively enforce the following provisions of Florida law: 
  • Chapter 509.292, F.S. – Misrepresenting food or food product; penalty, 

(1) An operator may not knowingly and willfully misrepresent the identity of any food or food product to any of the patrons of such establishment. The identity of food or a food product is misrepresented if: 

(a) The description of the food or food product is false or misleading in any particular; 

(b) The food or food product is served, sold, or distributed under the name of another food or food product; or 

(c) The food or food product purports to be or is represented as a food or food product that does not conform to a definition of identity and standard of quality if such definition of identity and standard of quality has been established by custom and usage. Section 3- 601.12, Food Code (2009) – Honestly Presented Food 

  • Approval. All items are subject to the approval of the Board and/or Market Committee. Any new items not previously approved must be submitted by the vendor for approval by the Board before being offered for sale. 
  • Alcoholic Beverages. No alcoholic beverages may be offered for sale, unless approved prior by EES Board and/or Market Committee. 
  • Open Flames. No open flame is allowed at any Market, without prior approval of Market Management 
  • Penalties and Fines. Failure to adhere to any of the requirements set forth in the Market Rules may result in penalties (for example, suspension for one or more Market days) and/or monetary fines, at the Market Manager and Board’s sole and absolute discretion. All fines must be paid before a vendor will be permitted to participate in the next Market. 
  • Communications. All communications required under these rules must be directed to EES at experteventsolutionsfl@gmail.com

 

VI CATEGORY-BASED VENDOR REQUIREMENTS Vendors must adhere to the following requirements based on vendor cateinfo@diglocal.orggory. 

  1. All Agricultural Producers must: 

Grow at least seventy-five percent (75%) of the produce offered for sale.

 a.Farmers are subject to field inspections at their farm to verify the source of products offered

   for sale.   

  1. Source all produce offered for sale that is not grown by the Farmer as follows

 c.No more than 25% of produce offered for sale may be sourced from other growers;

  1. All produce offered for sale must be locally grown in Florida or Southern  Georgia and be

    sourced directly from local growers. No store-bought or other purchased items may be

   offered for sale; 

  1. All produce not grown by the Farmer must have the source documented, including the grower name, location, and contact information. This information must be provided to the Market Manager for approval before the items may be offered for sale; and 
  2. From July 1st through September 30th, the ratio may be increased to 50% purchased from other farms. 
  3. Display a reader board, before the Market opens, that lists all items not grown by the Farmer and the name of the farm or grower from which those items were sourced. 
  4. Label all items offered for sale according to the method by which they 

were grown (organic, pesticide-free, conventional) using tags provided by the Market Manager. It is the responsibility of the Farmer to display the tags each week. 

  1. All agricultural producers are subject to site inspections by EES management. Access to all properties from which items are being sourced for sale at the Markets is required, as well as any processing or storage facilities. 
  2. Product liability- Food vendors are required to submit their Certificate of Insurance for Comprehensive General Liability with limits of $1,000,000 per occurrence and $1,000,000 aggregates. Expert Event Solutions LLC, New Smyrna Beach, FL, Eat - Drink - VegFest, Daytona Beach, FL, Riverfront Esplanade, the City of Daytona Beach, and Volusia County, FL shall be listed as additional insureds and provided with a ten-day cancellation notice. 

 

  1. All Processed and/or Value Added (foods or beverages) Food Vendors must: 

a.Make all food items offered for sale. An exception is allowed for items made by an immediate family member. No store-bought or otherwise purchased food items may be offered for resale. 

  1. Offer only foods that are made with local and/or organic ingredients; 
  2. An appropriate Business License. 
  3. Florida Sales Tax I.D. 
  4. Food Vendor: MUST have a Certified Kitchen or Commissary. This could be a restaurant, civic organization, or church that may lease you their kitchen during non-business hours. Food cannot be prepared in a home as Florida state regulation does not allow inspectors to enter a private residence. 

Requirements;

  1. Dept. of AG/FDACS license and inspection (selling packaged items baked goods, jellies, dips, sauces, etc.)
  2. Business & Professional Regulations! FL-BPR) license and inspection (selling and serving food cooked on site). 

NOTE: If what you wish to sell at the market is not listed, contact experteventsolutionsfl@gmail.com  to determine the acceptability of your product. 

  1. NO political or religious organizations or national distributorship is permitted. 
  2. Not-for-profit organizations selling food are permitted on a limited and space available basis. 

 

3.All Plant Vendors must: 

  1. If plants are sold in soil, producers are required to have a nursery license; 
  2. Obtain a certificate of inspection through the Department of 
  3. Agriculture; 
  4. Grow, or stock at the Plant Vendor’s nursery, all plants offered for sale. 

No plants may be offered for resale; 

  1. Offer only non-invasive plants for sale;
  2. Offer only plants that are healthy and free of insects or disease for sale; 
  3. Offer only plants that are Florida-friendly; and 
  4. Edible plants should be pesticide free. 
  5. are required to submit their Certificate of Insurance for Comprehensive General

 Liability with limits of $1,000,000.00 per occurrence and $1,000,000.00

 aggregates 

 

  1. All Craft Vendors must: 
  2. Make all items offered for sale. An exception is allowed for items made by one of the vendor’s immediate family members; and Offer only items made using environmentally and socially responsible parts and processes. 

 

  1. Food Trucks, Food Carts and Food Vendors must: 
  2. Food truck, food carts and food vendors sell ready-to-eat food. 
  3. The Eat - Drink - VegFest Market may allow food trucks, food carts, and food vendors to sell at the Markets, with approved documentation and insurance with prior approval by the EES

 Market Manager. 

These vendors will be assigned an area. 

  1. Location assignments for all food trucks & food cart vendors will be made by the

EES Market Manager. 

  1. No food truck or food cart vendor will be allowed to participate in the Markets if they

 have not been approved, and if the required paperwork is not in place. 

 

  1. APPLICATION APPROVAL PROCESS AND WAITLIST PROCEDURE To be considered for participation at the Market, each vendor must submit an application form, available on the Eat - Drink - VegFest Vendor registration website during the registration process https://runsignup.com/TicketEvent/EatDrinkVegFestVendorRegistrationPage.  
  2. Applications are accepted on a rolling basis. All participants must comply with the rules, procedures and operating guidelines. All applications must be approved by the Board and/or Market Committee before participation at the Markets. 

b.Producers shall make their points of production available to the Board and/or Market Committee as required to verify producer’s production. 

c.Change of business ownership requires submission of a new application to the Board and/or Market Committee, which will be processed as a new admission. The transfer or change of ownership does not grant or guarantee the new owner the same admission or current stall booth assignment as the previous owner. 

d.Admission of any participant and product is at the reasonable discretion of the Board and/or Market Committee. 

e.Participant’s product history and history of compliance with state, local government and market procedures are considered, along with: 

  • Participant/products’ history market participation. When practical, significant weight, priority, and preference should be given to producers returning from previous seasons. 
  • The competitive availability of producers/products present within the market. If practical, monopolies should be avoided. 
  • The type of relative quality of the product intended to be offered for sale by the producer. 
  • The number of unreserved spaces, other limitations and market policies affecting producers/product admission. Admission of a product to be sold by a particular producer may be conditioned by period of sale, location of sale, variety, quality and other general or specific limitations. 

f.Existing vendors must renew their Vendor Agreement for each year of the market. The vendor must sign the agreement prior to the market or will be denied entry to the market and made inactive until the signed agreement is returned.

g.If a vendor is made “inactive” due to not signing or late return of agreement, then “active” status will depend on available booth space at the market. Unpaid invoices from the markets year must be paid in order for a renewed application to be considered. 

h.Priority for vending at the Markets are given to those vendors whose product and practices best fulfill the mission of the Market. Due to space constraints, accepted vendors may be placed in a vendor pool (“Vendor Pool”) under the appropriate category (Agricultural Producer, Processed and/or Value-Added Food Vendors, Plant Vendors, Craft Vendors, Nonprofits, Local Business Spotlight, and Other Participants). When space becomes available, the Board will determine who from the Vendor Pool will fill the available space. The Board will consider both the position of each vendor in the Vendor Pool as well as the needs of the Market. 

While in the Vendor Pool, vendors may be asked to fill in on certain days when regular vendors are absent. 

 

  1. REVIEW OF ACTIVE VENDORS The Board and Market Committee reserve the right to review any vendor at any time to ensure that the vendor and his or her products fulfill the mission of the Market. Failure to adhere to any of the Market Rules may result in the assessment of fines,inactive status from the Market for one or more Market days, and/or the cancellation of the Vendor Application and Agreement. Fines must be paid by the violating vendor before the vendor will be permitted to set up at the next Market. Severity of penalties will be dependent upon the nature and intent of the offense and may or may not follow in the order below: 
  2. A verbal warning 
  3. A written notice of violation 
  4. A written notice of violation with a $25.00 fine 
  5. A written notice of violation with a fine determined by violation 

Although the Board and Market Committee will attempt to give vendors opportunities to remedy violations, the Board and Market Committee reserve the right to determine which vendors will be invited to the Market. Egregious violations may result in immediate removal from the Market schedule upon the sole discretion of the Board. 

Management reserves the right to remove displays or products as necessary. 

 

  1. MARKETING 

1.Market Newsletters - The Board and/or Market staff work to send out weekly reminders for each market. These efforts are greatly improved when vendors register and ahead of time for booth spaces. This provides a more accurate list that can be provided to potential customers. Vendors who have not registered and paid for their booth space will not be mentioned in the market newsletter. The goal of each newsletter is to focus on immediate upcoming events and markets. For seasonal vendors, notice will be given of their return the week of their first pre-registered market. 

  1. Social Media - The Board and/or Market staff are not required to focus on any specific vendor or product on official EES platforms. However, EES strives to provide fair and regular coverage of the market as a whole, and with proper planning (and content provided by the vendor) vendors and products can be highlighted. 

 

  1. OPERATIONS

1.Vendors shall limit sales activities to their booth area(s). No solicitation outside of the stalls or out-crying will be permitted. 

2.Vendors are expected to keep adequate change for sales transactions. Market management does not keep changing. 

3.Vendors are expected to keep cash secure; Market is not responsible for any lost or stolen cash. 

5.Vendors are responsible for collecting and paying appropriate sales tax. 

6.Vendors who sell-out are expected to stay until the end of the Market day to prevent disruption of the Market for customers. Vendors must display a “SOLD OUT” sign. 

7.Vendors may only distribute flyers within their stalls. 

8.No radios or music is permitted in the stalls, except for vendors demonstrating instruments for sale. 

9.Vendors must maintain appropriate attire, including shoes, at all times 

10.Smoking is prohibited within the stalls and common Market areas. Vendors who do smoke are expected to wash hands before returning to their stall. 

11.No vendor shall consume any alcoholic beverage before or during the Market. 

Rules, Procedures, and Operating Guidelines- Effective 2022

12.Vendors offering samples must supply garbage receptacles for customers’ use. Vendors are expected to keep the booth area free of trash and debris throughout the Market day. Vendors are encouraged to separate recyclables. 

13.Vendors are expected to act with professionalism, honesty and courtesy towards customers, other vendors, Market management, and City and Park employees. Any statement or action deemed to be offensive, abusive, or otherwise inappropriate will be considered a violation of these Standard Operating Procedures and is subject to disciplinary action as indicated herein. 



Violation: Violations of these Standard Operating Procedures may result in a fine, penalty or other disciplinary action. The severity of any penalty or discipline imposed shall be directly related to the gravity or repetition of the violation. Severity of penalties will be dependent upon the nature and intent of the offense and may follow in the order below: 

- Verbal warning - Written notice of violation - Written notice of violation with a $25.00 fine 

 Written notice of violation with a fine determined by violation - Market suspension of up to eighteen months 

Vendors are responsible for the actions of the vendor’s representatives, employees or agents. 

If possible and reasonable under the circumstances, Market management must attempt to give adequate warning and notice of consequential action prior to the actual action of removal or other disciplinary action. 

Market management will review all disciplinary actions at regularly scheduled meetings. 

Any producer removed or disciplined by the action of Market management or the County may complain in writing to experteventsolutionsfl@gmail.com

If a vendor challenges Expert Event Solutions or the City of Daytona Beach or Volusia County, Florida in a court of law and the court finds in favor of Market management or the City of Daytona Beach and/or Volusia County, said vendor agrees to pay all costs associated with the legal action. 

 

ACKNOWLEDGEMENT I have read and understand the Expert Event Solutions Market Rules, Procedures, and Operating Guidelines and agree to abide by them.
