HALLOWEEN NIGHTS

Waiver, Acknowledgment of Risk, and Release of Liability

By checking the box at checkout, each purchaser, on behalf of themselves and every guest included in this ticket order, acknowledges that they have read, understood, and agree to the following terms as a condition of entry to Halloween Nights (the “Event”), hosted by Babcock Ranch Residential Association, Inc. (“Association”):

1. Nature of the Event; Assumption of Risk. I understand that Halloween Nights is a theatrical Halloween-themed attraction that includes, without limitation, strobe and flashing lights, sudden bursts of light or darkness, loud and sudden noises, fog and haze effects, low lighting and areas of near-total darkness, fabricated scenery, uneven or unfamiliar walking surfaces, stairs, ramps, tight or narrow passageways, simulated hazards, and other theatrical special effects (collectively, the “Effects”). I voluntarily choose to attend and participate in the Event with full knowledge of the Effects and the risks described in this document, including the risk of trips, falls, minor injury, and psychological or emotional reactions such as fright or anxiety, and I voluntarily assume all such risks.
2. Photosensitive Seizure / Health Warning. The Event uses strobe lighting and rapid flashing effects that may pose a risk to individuals with photosensitive epilepsy or other light-triggered conditions. Guests with epilepsy, heart conditions, respiratory conditions, mobility limitations, anxiety or panic disorders, or who are pregnant, should consult a physician before attending and should notify Event staff of any relevant condition before entering. Guests may exit the attraction at any time through marked emergency exits.
3. No Live Actors Inside the Attraction. Guests are advised that there are no live actors, performers, or staff positioned inside the haunted house/walk-through portion of the Event. All frights, movement, and effects inside the attraction are generated by mechanical, electronic, pneumatic, or recorded means. Any live actors, greeters, or staff associated with the Event are located only in queue lines, entry areas, or other designated exterior/front-of-house locations.
4. Supervision of Minors. Guests under the age of 15 must be accompanied at all times by a parent, guardian, or other responsible adult (18 years or older) who remain with the minor throughout the Event. The purchaser represents that they are 18 years of age or older, have the authority to make purchasing and admission decisions for every minor included in this order, and will ensure the supervision requirement above is met.
5. No Touching Props, Sets, or Effects Equipment. Guests must not touch, climb on, lean against, or otherwise interact with props, scenery, set pieces, decorations, lighting, fog machines, or other special-effects equipment. Guests agree to remain on designated pathways, to follow posted signage and the instructions of Event staff and understand that props and effects may be operated by unattended machinery that can cause injury if touched or tampered with.
6. General Conduct and Right of Removal. Association reserves the right to refuse admission or remove any guest, without refund, for conduct that endangers others, violates posted rules, involves intoxication or use of illegal substances, or otherwise disrupts the Event.
7. Release and Waiver of Liability. To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue Association and its officers, directors, employees, agents, volunteers, contractors, sponsors, and the owner of the premises on which the Event is held (collectively, the “Released Parties”) from any and all liability, claims, demands, or causes of action arising out of or related to my attendance at or participation in the Event, including claims arising from the negligence of the Released Parties. In addition, I, as the parent or legal guardian of each minor included in this order, waive and release, on behalf of each such minor, any prospective claim of that minor for damages arising from the negligence of the Released Parties in connection with the minor's participation in this Association-sponsored activity. This release does not apply to, and nothing in this document waives, liability for gross negligence, recklessness, or intentional misconduct, or any other claim that cannot be released as a matter of law.
8. Indemnification. I agree to indemnify and hold harmless the Released Parties from any loss, damage, injury, or claim arising from my acts or omissions, or those of any minor in my party, including damage to Event props, sets, or equipment.
9. Photo and Video Release. I grant Association and its designees a perpetual, worldwide, royalty-free right to photograph and record video/audio of me and any minors in my party while at the Event, and to use, reproduce, edit, and distribute such images and recordings in any media, including for marketing, advertising, and promotional purposes, without further notice or compensation. Guests who prefer not to be photographed or recorded may identify themselves to Event staff at the entrance to request reasonable accommodation (such as avoiding designated photo areas), though Association cannot guarantee exclusion from incidental crowd or wide-shot footage.
10. No Refunds for Risk Disclosures. I understand that the matters disclosed in this document (including the Effects, the absence of live actors inside the attraction, and the supervision requirement) are known conditions of the Event and are not grounds for a refund after entry.
11. Electronic Signature. I understand that checking the box constitutes my electronic signature and acceptance of this document, with the same legal effect as a handwritten signature, and that a copy will be retained by Operator and made available to me upon request.
12. Severability and Governing Law. If any provision of this document is held invalid or unenforceable, the remaining provisions will remain in full force and effect. This document is governed by the laws of the State of Florida, without regard to conflict-of-law principles.

I have read this Waiver, Acknowledgment of Risk, and Release of Liability in its entirety, understand it, and agree to be bound by it, on behalf of myself and every guest included in this ticket purchase.
