MINOR PARTICIPANT ATHLETIC WAIVER AND RELEASE OF LIABILITY

IMPORTANT: THIS IS A LEGAL DOCUMENT. READ CAREFULLY BEFORE SIGNING.

In consideration for the participation of the minor identified below (“Participant”) in any programs, events, practices, competitions, or activities sponsored or conducted by Valley Ranch Residential Association (“VRRA”), the undersigned parent or legal guardian (“Parent/Guardian”) agrees as follows:

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I understand and acknowledge that participation in physical activities involves INHERENT AND SIGNIFICANT RISKS, including but not limited to bodily injury, illness, permanent disability, paralysis, and death.

I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS, both known and unknown, on behalf of the Participant.

2. RULES, REGULATIONS, AND DISCIPLINE

I agree that the Participant will comply with all rules and policies. I understand that failure to comply may result in suspension or removal, at VRRA’s sole discretion.

3. RELEASE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I, ON BEHALF OF MYSELF AND THE PARTICIPANT, HEREBY RELEASE, WAIVE, AND DISCHARGE VRRA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, AND AFFILIATES (COLLECTIVELY, THE “RELEASEES”) FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, OR LIABILITIES ARISING OUT OF OR RELATED TO THE PARTICIPANT’S INVOLVEMENT IN ANY VRERA ACTIVITY.

THIS RELEASE INCLUDES CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASEES, TO THE FULLEST EXTENT PERMITTED BY LAW.

4. COVENANT NOT TO SUE

I AGREE, ON BEHALF OF MYSELF AND THE PARTICIPANT, NOT TO FILE OR PURSUE ANY CLAIM OR LAWSUIT AGAINST THE RELEASEES FOR ANY CLAIMS COVERED BY THIS AGREEMENT.

5. MEDICAL AUTHORIZATION

In the event of an emergency, I authorize VRRA and its representatives to obtain medical treatment for the Participant as deemed necessary. I understand that I am solely responsible for any costs related to such treatment.

6. GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of the State of Texas, and any legal action shall be brought exclusively in a court of competent jurisdiction in Texas.

8. SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

7. ACKNOWLEDGMENT OF UNDERSTANDING

I certify that I am the legal parent or guardian of the Participant, that I have READ THIS AGREEMENT CAREFULLY, fully understand its terms, and sign it voluntarily. I understand that I am GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
